  
           California's Largest Lemon Law Firmsm  
          If you were unlucky enough to get a
          lemon, then you know just how frustrating one of these vehicles can
          be!  The California Lemon Law may offer you the relief you seek,
          in the form of a refund of monies and payments you have made, or a
          replacement vehicle.  In some cases we may potentially negotiate

          In California, any vehicle that is
          sold new or used and covered by a manufacturer’s warranty, or
          “CPO” used vehicle warranty, can be a potential candidate for
          California lemon law protection. Here are some examples of vehicles
          with factory/manufacturers warranties:
          
           
          1.     
          Manufacturers original New Vehicle Limited Warranty (typically
          3 years/36,000 miles or 4 years/50,000 miles). This is more commonly
          known in the trade as “bumper-to-bumper” portion of the warranty.
          
           
          2.     
          Manufacturers original New Vehicle Limited Warranty
          “Powertrain” coverage. (typically 5 or 6 years/up to 70,000
          miles). Some manufacturer’s like Kia and Hyundai offer to the original owner a “10 year/100,000 mile Powertrain warranty”.
          
           
          3.     
          Ford, Dodge and GM/GMC offer a 10 year/100,000 mile warranty on
          their diesel engine equipped 2500 and 3500 series trucks.
          
           
          4.     
          Each manufacturer offers a “Certified Pre-Owned Warranty”
          on qualifying used cars. These warranties cover specific components
          only, and are not a “bumper-to-bumper” warranty. This is not to be
          confused with a “dealer certified warranty”. This is NOT from the
          manufacturer.
          
           
          What about “extended
          warranties?’” There is no such thing as an “extended warranty”
          to BUY in from the car dealership in California (excepting Mercedes
          “STARMARK” used vehicle warranties). All others are merely
          “Service Contracts” or “Mechanical Breakdown Policies”, which
          are sold by the dealerships, and in California, are NOT applicable to
          the California lemon law.
          
           
          Vehicles in   statutory
          requirements:
          
           
          If sold or leased as NEW:
          
           
          1.     
          Vehicle has been subject to 4 or more repairs for the same
          substantial problem. (this can be anytime during the whole New Vehicle
          Limited Warranty period/Powertrain Warranty period, or diesel engine
          warranty period).
          
           
          2.     
          Vehicle has spent over 30 days in the shop cumulatively
          during the first 18 months/18,000 miles (whichever comes first).
          
           
          3.     
          Vehicle has spent a continuous
          30 days in the shop during the first 18 months/18,000 miles due to
          backordered/inability to get repair parts in
          
           
          If sold or leased as USED:
          
           
          1.     
          Vehicle’s sold with the balance of the manufacturer’s New
          Vehicle Limited Warranty or “Powertrain” warranty, or diesel
          engine warranty.
          
           
          2.     
          Vehicle’s sold as “CPO” (Certified Pre-Owned Warranty),
          which is backed by the vehicle’s manufacturer
          
           
          3.     
          Vehicle’s sold as “previous Lemon Law buybacks”. These
          vehicles come with a 1 year/unlimited mileage warranty by the
          manufacturer for the defects that made it a “lemon law buyback” by
          the manufacturer.
          
           
          Attempting to get a manufacturer to
          buy back or replace your defective vehicle can be a daunting and
          overwhelming task. Why? – Because the automobile manufacturer does
          not have to do anything for you directly, as you have virtually no legal power over
          them. That’s why you hire an attorney. Even *if* an
          automobile manufacturer made you a “offer”, by dealing direct with
          the consumer they do NOT have to follow the California lemon law, and
          routinely don’t! Or worse yet, they simply offer a monthly payment
          back, or some other “gesture of goodwill”.
